1. Acceptance of these terms
By accessing this website or engaging Infinex Corporation("Infinex", "we", "us") for services, you agree to these Terms & Conditions. If you are agreeing on behalf of an organisation, you confirm you are authorised to bind that organisation.
2. Who we are and what we do
Infinex is a technology and software services company. We act as the technology partner for financial businesses — including NBFCs, gold-loan operators and other finance-led enterprises — by designing, building, hosting, integrating, maintaining and operating software platforms on their behalf.
Important — what Infinex is not. Infinex is not a bank, non-banking financial company (NBFC), lender, payment system operator or financial institution. We do not lend money, disburse loans, accept deposits, hold customer funds, operate as a lending or investment platform, or provide any financial, legal, tax or investment advice. All financial products, credit decisions and customer money flows belong to and are the responsibility of our clients under their own regulatory licences.
3. The client relationship
Where Infinex builds or operates a platform for a client, the following allocation of responsibility applies:
| Infinex is responsible for | The client (financial institution) is responsible for |
|---|---|
| Software development, hosting, security, integrations, support and platform operations under the agreed contract. | Being the lender / financial institution of record, holding all required licences and regulatory approvals, and owning the customer relationship. |
| Delivering the technology to agreed specifications and SLAs. | All lending, underwriting and financial decisions, the movement and custody of funds, and compliance with RBI and other regulations. |
End customers of a client platform (for example, borrowers) have their contractual relationship with the client, not with Infinex. Their use of the platform is governed by the client's own terms and policies.
4. Scope of services
The specific services, deliverables, timelines, fees and service levels for any engagement are set out in a separate written agreement, proposal or statement of work ("Service Agreement"). Where these Terms and a signed Service Agreement conflict, the Service Agreement prevails for that engagement.
5. Payments, transactions and money flows
This section clarifies how money is handled in connection with our work:
- Fees to Infinex. You pay Infinex for its technology services (for example, development, licensing, hosting and support) as set out in the applicable Service Agreement and invoices. These are the only payments Infinex collects on its own account.
- Customer and loan transactions. Any loan disbursement, repayment, EMI, interest, fee or other transaction between an end customer and a financial institution is a transaction of that institution. Infinex does not hold, own or take custody of these funds; it only provides the software through which the client operates.
- Payment processing.Where a platform moves money, it does so through the client's own bank accounts, licensed payment providers and settlement arrangements. Infinex is a technology facilitator and is not the payer, payee or settlement entity for those transactions.
- Taxes. Fees payable to Infinex are exclusive of applicable taxes (such as GST), which are charged in addition where required.
Refunds of fees paid to Infinex are governed by our Refund Policy. Refunds, reversals or chargebacks relating to a loan or customer transaction are handled by the relevant financial institution, not by Infinex.
